Starting a Case in Federal Court

You start a judicial review with a Notice of Application (Form 301). 

On this Form you include:

  • who made the decision, for example, a First Nation Council
  • details about what was decided
  • what you want the court to do, for example, overturn a decision or the results of an election
  • why the court should do what you are asking them to and any laws that support your case
  • a list of any evidence you will use to support your case including any Affidavits you will file and any documents you have asked the decision maker to give you 

Filing the Notice of Application

The Court Registry is where you file documents. There is an office in Ottawa and offices in other parts of the country. Parties can file their documents with the registry closest to them.  There are offices in Saskatoon and Regina.

You make three copies of the completed application and deliver them to the Receiving Office closest to you. This can be done  in-person or by mail. They will stamp them and send or give one back to you.

Filing Other Documents

Because they do not need to be stamped, you can file other documents online through the Federal Court website. To do this it must be a PDF. 

You can also file by fax. If the document is more than 20 pages you need the permission of the court for this. If you file by fax you need to include a cover page with the following information:

  • your name, address and telephone number
  • the date and time of the fax
  • the total number of pages being faxed, including the cover page
  • a fax number that can be used to send documents to you
  • the name and telephone number of a person who can be contacted if there is a problem with the fax
