Serving the Notice of Application

You need to serve your Notice of Application within 10 days of when it was stamped by the registry. 

Who to Serve

You need to serve the body that made the decision, anyone else who participated in the case and the Attorney General of Canada. The court will serve the Attorney General of Canada for you. 

You need to file proof of service within 10 days after you serve the Notice of Application. Prove is by an Affidavit in Form 146A. If the other party has a lawyer, you can use an acknowledgement of service signed by the lawyer or someone in their office.

You can serve the person by:

  • leaving the document with the person
  • leaving the document with an adult who lives with the person and mailing a copy to the person at that address
  • if it is a business, giving it to a person in charge at the business (not if the business is a partnership)
  • mailing the document to the person’s last known address, along with an acknowledgement of receipt form in Form 128 - in this case the person needs to return the acknowledgment to you, or they need to sign a post office receipt
  • mailing the document by registered mail to the person’s last known address -in this case they need to sign a post office receipt
